The Content
1.1 By responding with "#YesAlfa", you grant FCA and its subsidiaries, affiliates, agents, employees, representatives, assignees, and anyone else acting on behalf of FCA or with its permission, the right to:

1. a) Use your photos, videos, posts, and/or other online content as selected by FCA (the "Content") for commercial purposes, on any social media platform, in promoting FCA products or services, regardless of the media used.
2. b) Record, reproduce, copy, issue copies, print, publish, or communicate the Content to the public;
3. c) Modify, edit the Content including incorporating it into or with any other elements (videos, photos, etc.) chosen by FCA for the above-mentioned purpose, while respecting the dignity and decorum of the subjects portrayed, all without paying any compensation, now or in the future, for any reason, to you or third parties, and without any right to review or approve the final product or to be credited for the Content.

1.2 By responding with "#YesAlfa", you grant FCA and its subsidiaries, affiliates, agents, employees, representatives, assignees, and anyone else acting on behalf of FCA or with its permission, the right to use the Content as described in these terms and conditions.

1.3 FCA shall have the right, at its sole discretion, to remove any Content from its social media platforms at any time, without reason or notice.

Intellectual Property
2.1 By responding with "#YesAlfa", you declare and warrant that:

The Content is your intellectual property and does not come from another source;

The Content does not violate mandatory laws and does not infringe any copyrights or third-party rights;

You have obtained all necessary permissions from any third parties whose images appear in the Content, provided that the Content does not include, even partially, minors;

You have not authorized or assigned the use of the Content or the rights therein to any third party;

Nothing in the Content you provided is or may be considered defamatory, obscene, or threatening towards third parties or, in any case, may violate any law, regulation, or ruling from any court or public authority;

You are of legal age and have the right to accept these terms and conditions on your own behalf.

Indemnity

3.1 By responding with "#YesAlfa", you agree to:
B) Release and hold harmless FCA from:

Claims, actions, demands, lawsuits, or intellectual property disputes raised by third parties related to the Content, including but not limited to copyright and/or image rights violations, as well as any direct or indirect, substantial damages, costs, charges, and expenses (including legal fees) incurred by FCA;

Any claim, demand, lawsuit related to (a) the use of Content for which you do not have the right to use or license and/or (b) the disclosure of information for which you do not have permission to disclose (e.g., confidential third-party information), including all related damages and costs as above;

Any other actions, claims, demands for breach of the warranties in article 2.1, including all direct or indirect damages, costs, charges, and expenses (including legal fees) incurred by FCA.

C) Seek and act to ensure FCA's exclusion from any proceedings and/or lawsuits and reimburse FCA for any amounts or expenses incurred or to be incurred in relation to such proceedings and/or lawsuits, and indemnify FCA for any damages or losses resulting from them.
3.2 By responding with "#YesAlfa", you also authorize FCA to disclose your personal data to any third party that may raise claims against FCA as per article 3.1.

Data Protection
4.1 The data controller is FCA Italy S.p.A., headquartered at Corso Giovanni Agnelli 200 - 10135 Turin, Italy.
4.2 FCA Italy S.p.A. has appointed a Data Protection Officer (DPO), who can be contacted via email at dpo@fcagroup.com
4.3 The data controller will process the following categories of personal data:
a) Contact details (which may include username, first name, last name);

b) Images/photos;

c) Other personal data possibly included in the Content.
4.4 The Controller will retain your personal data for six years, subject to your right to withdraw your consent at any time by writing to [privacy@fcagroup.com]. If you delete the content, FCA will no longer use it.
4.5 Processing requires your explicit consent (expressed by responding with "#YesAlfa", which serves as the legal basis for processing).
4.6 The collected personal data will be processed manually and/or using IT tools for the implementation of the "#YesAlfa" initiative and for the commercial purposes stated in these Terms and Conditions.
4.7 Your personal data may be made accessible and/or transferred, for the purposes in section 3.6, to employees and/or collaborators and/or suppliers of the Controller, who may be designated as data processors when required.

Governing Law and Jurisdiction
6.1 This agreement is governed by Italian law.
6.2 For any dispute regarding the interpretation and/or execution of this agreement, the Court of Turin shall have exclusive jurisdiction.

By responding with "#YesAlfa", you confirm that you have voluntarily made the Content available to FCA without receiving any incentives, assurances, or guarantees from FCA, and that you have read, understood, and accepted all of the above terms and conditions.
